General Terms and Conditions of sale

1. Scope of application

The customer acknowledges the general terms of sale as described below. These general terms and conditions of sale apply to transactions made on the www.psalmus.com internet website.

2. Applicable law

All the clauses figuring in the present general terms of sale are controlled by French law.

3. Orders

Any order made on the website entails that you accept the present general terms and conditions of sale. After consulting relevant website information in your order, you first must identify yourself to place an order. For that purpose you must complete a registration form, with the help of the provided instructions. Completing this information serves as proof of your identity and your commitment, and allows your order to be processed.

The registration of your order takes place as soon as your payment has been validated. As soon as the order is received, PSALMUS will carry out the necessary controls for its consideration (conformity of the order, contact details…). In order to process your order, PSALMUS might need to contact you to request further documentary evidence, in particular with regards to the total amount of your order. PSALMUS reserves the right to refuse providing the ordered goods, should you not meeting the required conditions mentioned in these terms and conditions of sales.

4. Products availability

The offers, goods and prices are valid as long as they are visible on the site and are subject to stock availability. In case the product is temporarily out of stock, the order will be held over until all the goods are available. When a product is definitely out of stock, you will be informed by email. In this case the order will be cancelled, without such cancellation being a cause for compensation.

5. Prices

The prices of the goods mentioned are in Euros (€), inclusive of taxes, but not of delivery costs. Delivery costs are payed by the customer. The price of the goods is the one in force at the time of consulting and validating the order. The content and the price of the offers may be changed in accordance with the offers.

For any order coming from a foreign country or the French overseas administrative departments and territories (DOM-TOM), the price of your purchase is equal to the price of the order inclusive of taxes. For orders coming from a foreign country, with the exception of European Union country members, any possible taxes (customs duty, import tax, local VAT etc) may be charged at the reception of the goods and are payable by the customer. The amount of these taxes depends on the regulations in force in the country of destination. It is the responsibility of the customer to be informed of the necessary information by the local authorities concerned, and to respect the specific procedures which apply to the import of merchandise into the country of destination.

6. Payment

Purchases can be made directly by debit card on the website. In order to optimize the security of transactions, the website proposes a secured online payment system (PayBox).

All of the information relative to your order (including your name, address and debit/credit card credentials) will be encrypted in order to protect all the information that you communicate to us during the transfer. The means and the benefits of the encryption used to secure the transactions are subjected to legislation in force, and declared to the relevant authorities. The account will be debited immediately. The order will be definitively registered and treated on reception of the validation of payment.

You may also pay for your purchases by cheque from a French bank account. The cheque must be sent to the following adress: PSALMUS, 2 impasse Pompière, 33110 Le Bouscat, France. In this case the order will be definitively registered and treated on reception of the cheque and if need be, after consultation of the national register of unpaid cheques. The cheque will be cashed immediately.

7. The right to reserve ownership

The ownership of the goods ordered will only be transferred to you once payment of the invoice and the delivery costs has been made.

8. Delivery

Goods can be delivered to mainland France, Corsica, the French overseas administrative departments and territories (DOM-TOM), as well as the countries indicated  on the website as available for delivery when the order is made.

The goods will be delivered to the address given during the order. Delivery times suggested on the site are not contractual, and are based on average postal delivery times dating from the definitive reception of payment. These delivery times may vary according to the final order destination. In case of articles being delivered at different dates due to their availability, the indicative delivery times will be based on the longest. PSALMUS reserves the right to make separate deliveries; the participation of postal costs therefore, will be for only one consignment. PSALMUS will not be held responsible for the consequences due to delivery delays. For mainland France, the discs are sent by first class post. For all other zones, the goods will be sent by registered post. In order to assure the deliveries in the best delays, it is necessary to indicate the name and telephone number of the addressee during your order.

9. Force majeure

PSALMUS cannot be held responsible in case non-fulfilment, or the delay of fulfilment of one, or several obligations contained in the present contract results from force majeure. The following conditions are considered as cases of force majeure; exceptional weather conditions, natural catastrophes, fires and floods, lightening, electronic power surges, terrorist attacks, strikes, legal or regulatory restrictions to the supply of telecommunication services and all other event of force majeure or fortuitous case in the article 1148 of the French civil code.

10. Settlement of disputes

All the contractual measures defined above are ruled by French law. Our customer service is at your disposal for the settlement of any dispute, and in the case that an out-of-court settlement cannot be reached, the case will come under the jurisdiction of the Bordeaux court.
